We at Shuttersong Incorporated ("Shuttersong," "we," "us," or "our") know that our users ("you," "your," or "yourself") care about how your personal information is used and shared, and we take your privacy seriously. Please read the following to learn more about our Privacy Policy.

Shuttersong, Incorporated is the parent business of Adsonica. This policy relates solely to the products and services available from Adsonica.

Our Privacy Policy explains how we and some of the companies we work with collect, use, share and protect information in relation to our advertising application (the "App"), our web site located at www.adsonica.com (the "Site"), and any software provided on or in connection with the App or the Site (collectively with the Site and the App, the "Service"), and your choices about the collection and use of your information.

By using our Service you understand and agree that we are providing a platform for you to create advertising materials ("Ad Content"), on the Service and to transmit that content to third-parties.

Our Policy applies to all visitors, users, and others who access the Service ("Users").

Adsonica may change this Privacy Policy from time to time, so please review it periodically. You can review the most current version of our Privacy Policy at any time at the Site at www.adsonica.com/privacy.html. Your continued use of Adsonica or the Service after any modifications to this Privacy Policy will constitute your acceptance of such modifications.

While we may make this Privacy Policy available in other languages, the English text is the sole version for any legal or regulatory matters.

Information We Collect

We collect the following types of information:

Information you provide us directly:

Your username, password and e-mail address when you register for a Adsonica account.

Profile information that you provide for your user profile (e.g., first and last name, company name, phone number).

User Content (e.g., image and audio files, comments, and other materials) that you create on the Service.

Communications between you and Adsonica, including but not limited to support requests, security notices, content of images, product feedback and account settings.

Information we collect automatically:

Whenever you interact with the Service we automatically collect anonymous information about you through the use of "cookies." "Cookies" are identifiers we transfer to your computer or device that allow us to recognize your browser or device and enable us to remember you for future visits, to ensure that your Adsonica files are uploaded smoothly, and to enable new features of the App that may require cookies. You will not be able to sign in to the App without having cookies enabled.

We use third-party analytics tools to help us validate installation of the software, measure traffic and usage trends for the Service, and to report failures or other issues. These tools collect information sent by your device or our Service, including the web pages you visit, add-ons, and other information that assists us in improving the Service. We collect and use this analytics information with analytics information from other Users so that it cannot reasonably be used to identify any particular individual User.

When you use our Service, our servers automatically record certain log file information, including your web request, Internet Protocol ("IP") address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Service, domain names, landing pages, pages viewed, and other such information. The information allows for more accurate reporting and improvement of the Service.

We may also collect metadata, which is usually technical data that is associated with User Content. For example, Metadata can describe how, when and by whom a piece of User Content was collected and how that content is formatted.

We do not collect, store or process any personally identifiable information from audiences viewing or interacting with advertisements created using our Services. All serving is performed by third-parties selected by you. We do not use cookies, web beacons, pixels, trackers or tags in any form related to personally identifiable information. It is your responsibility to read the privacy policy of any third-parties.

How We can use your information

In addition to some of the specific uses of information we describe in this Privacy Policy, we may use information that we receive to:

Help you efficiently access your information after you sign in

Remember information so you will not have to re-enter it during your visit or the next time you visit the Service;

Provide, improve, test, and monitor the effectiveness of our Service

Develop and test new products and features

Monitor metrics such as total number of visitors, traffic, and demographic patterns

Diagnose or fix technology problems

To send periodic emails. The email address provided by you for order processing may be used to send you information and updates pertaining to your order, in addition to receiving occasional company news, updates, related product or service information, etc.

We currently do not process credit card or other financial transactions on our Site. We use third-party credit card and financial processing companies to accept payments from customers. We receive and store the results from these payment processing transactions.

Shuttersong does not sell or rent your personal data to any third-party without your consent, except as noted in this Policy.

Parties with whom we may share your information:

We may share User Content and your information (including but not limited to, information from cookies, log files, device identifiers, location data, and usage data) with businesses that are legally part of the same group of companies that Adsonica is part of, or that become part of that group ("Affiliates"). Affiliates may use this information to help provide, understand, and improve the Service (including by providing analytics) and Affiliates' own services (including by providing you with better and more relevant experiences). But these Affiliates will honor the choices you make about who can see your photos.

We also may share your information as well as information from tools like cookies, log files, and device identifiers and location data, with third-party organizations that help us provide the Service to you ("Service Providers"). Our Service Providers will be given access to your information as is reasonably necessary to provide the Service under reasonable confidentiality terms.

We may remove parts of data that can identify you and share anonymized data with other parties. We may also combine your information with other information in a way that it is no longer associated with you and share that aggregated information.

What happens in the event of a change of control:

If we sell or otherwise transfer part or the whole of Adsonica or our assets to another organization (e.g., in the course of a transaction like a merger, acquisition, bankruptcy, dissolution, liquidation), your information such as name and email address, User Content and any other information collected through the Service may be among the items sold or transferred. You will continue to own your User Content. The buyer or transferee will have to honor the commitments we have made in this Privacy Policy.

Responding to legal requests:

We may access, preserve and share your information in response to a legal request (like a search warrant, court order or subpoena) if we have a good faith belief that the law requires us to do so. This may include responding to legal requests from jurisdictions outside of the United States where we have a good faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards. We may also access, preserve and share information when we have a good faith belief it is necessary to: detect, prevent and address fraud and other illegal activity; to protect ourselves, you and others, including as part of investigations. Information we receive about you may be accessed, processed and retained for an extended period of time when it is the subject of a legal request or obligation, governmental investigation, or investigations concerning possible violations of our terms or policies, or otherwise to prevent harm.

How we store and process your information

Adsonica takes reasonable precautions to protect Personal Information in its possession from loss, misuse and unauthorized access, disclosure, alteration and destruction. All Personal Information submitted by you through the Service is encrypted with secure server software to protect it from unauthorized access. Adsonica works to protect the security of Personal Information during transmission by using software that encrypts the information that is transmitted. Adsonica also has appropriate security measures in place within its database and physical facilities to protect against the loss, misuse, or alteration of Personal Information that has been collected through the Service. These measures include limiting the number of people who have physical access to Adsonica's database servers, as well as electronic security systems and password protections that guard against unauthorized access.

Adsonica does not provide any of your Personal Information to any non-agent third parties, other than to protect the interests or safety of Shuttersong.

Adsonica and its affiliates or service providers may transfer information that we collect about you, including Personal Information across borders and from your country or jurisdiction to other countries or jurisdictions around the world. If you are residents of the European Union ("EU"), some of your personal data may be stored digitally on servers located outside of the EU, subject to appropriate safeguards, including a contractual commitment requiring that the data will be processed only for limited and specified purposes consistent with your consent, that the recipient will provide the same level of protection, and that the recipient will notify us if it makes a determination that it can no longer meet those obligations. Information voluntarily supplied by our website users and customers may also be stored using "cloud" or other digital storage services, subject to those same safeguards. If you do not agree to such storage, you may terminate your account at any time and, for EU users, have the right to request access to or deletion of any personally identifiable data we collect and store.

You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to emails between you and Adsonica, at all times. We are not responsible for the functionality, privacy, or security measures of any other organization.

General Data Protection Regulation compliance

We comply with the European Union's General Data Protection Regulation, Regulation (EU) 2016/679 ("GDPR"), by transferring personally identifiable user data to a third country, specifically the United States, only with "appropriate safeguards" or consistent with another GDPR-approved transfer mechanism. We have certified our adherence to the PrivacyShield guidelines endorsed by the European Commission. We do not generally provide personally identifiable user information to third parties for data processing ("Processors"), but if and when we do so the Processors are subject to contractual obligations to implement appropriate technical and organizational security measures to safeguard the personal information and to process the data only as specifically instructed.

Additionally, pursuant to the GDPR and applicable data protection laws, users in the European Economic Area and other global locations may have the right to: (i) request access to your personal data; (ii) request rectification of your personal data; (iii) request deletion of your personal data; (iv) request restriction of processing of your personal data; (v) request data portability; and/or (vi) object to the processing of your personal data (including objection to profiling). This access information includes, among other things, the purposes of the processing, the categories of personal data concerned, and the recipients or categories of recipients to whom the personal data have been or will be disclosed. California Online Privacy Protection Act compliance

Because we value your privacy, we have taken the necessary precautions to be in compliance with the California Online Privacy Protection Act. We, therefore, will not distribute your personal information to outside parties without your consent. As part of the California privacy regime, all users of our Site may make any changes to their information at any time by signing into the Adsonica service and selecting "Account" from the drop-down menu on the top right corner.

Children's Online Privacy Protection Act compliance

We are in compliance with the requirements of COPPA (the Children's Online Privacy Protection Act); we do not collect any information from anyone under 13 years of age. Our Site and our Services are all directed to people who are at least 13 years old or older. If you are under 13, you are not permitted to become a user and should ask your parent or guardian to establish an account in their own name.

How long we keep your User Content

Following termination or deactivation of your account, Adsonica, its Affiliates, or its Service Providers may retain information (including your profile information) and User Content for a commercially reasonable time for backup, archival, and/or audit purposes. If the account was terminated or deactivated as part of a criminal investigation, Adsonica, its Affiliates, or its Service Providers may retain information (including your profile information) and User Content for as long as required by law enforcement or other authorities. To delete your account send an email to support@adsonica.com with "Delete" in the subject line. Depending on support volume it may take between 1-2 business days to respond to your request.

HOW TO VIEW OR CORRECT YOUR INFORMATION

Upon request, Adsonica will grant you reasonable access to Personal Information that it holds about you, and Adsonica will take reasonable steps to permit you to correct, amend, or delete information that is demonstrated to be inaccurate or incomplete. OTHER WEB SITES AND SERVICES

We are not responsible for the practices employed by any websites or services linked to or from our Service, including the information or content contained within them. Please remember that when you use a link to go from our Service to another website or service, our Privacy Policy does not apply to those third-party websites or services. Your browsing and interaction on any third-party website or service, including those that have a link on our website, are subject to that third party's own rules and policies. In addition, you agree that we are not responsible and do not have control over any third-parties that you authorize to access your User Content. If you are using a third-party website or service and you allow them to access your User Content you do so at your own risk.

You acknowledge and agree that it is your responsibility to review this Privacy Policy periodically and to agree with any modifications.
